CONDITIONS DE GARANTIE:
o Garantie six mois sur la pièce dès le montage, les preuves de montage par un
installateur professionnel et la pièce défectueuse à retourner avec le document
de garantie obligatoirement remplis complètement .
o Les demandes de garanties non acceptées sont retournées, seulement sur
demande du client (transport payant), dans la quinzaine après la
communication du résultat du test. Après la quinzaine, aucun retour est
possible, ni de remboursement.
Article 8. Garantie
1. Le Fournisseur n'accorde de garantie sur les Produits que si cela a été convenu par écrit.
2. Sauf convention différente formelle et écrite, le délai de garantie des Produits est de 12 mois suivant la livraison. En outre, pour les démarreurs et alternateurs, la garantie est limitée à 100 000 km maximum, sauf indication différente.
3. Si les marchandises sous garantie sont renvoyées au Fournisseur, l'Acheteur prend à sa charge les frais de transport ou d'expédition ainsi que les coûts pour le renvoi par transport ou expédition des Produits après leur réparation ou leur remplacement par le Fournisseur, sauf convention différente par écrit.
4. Les marchandises sous garantie qui sont renvoyées au Fournisseur par transport ou expédition pour leur réparation, leur remplacement ou leur examen, restent à tout moment aux risques et périls de l'Acheteur, quelle que soit la partie qui a déterminé le mode de transport ou d'expédition et quelle que soit la partie qui en paie les coûts.
5. Le Fournisseur ne donne expressément aucune garantie sur des Produits utilisés dans une exploitation minière ou montés ou intégrés sur ou dans des équipements, machines ou véhicules utilisés ou ayant servi dans une exploitation minière.
6. En cas de réclamation présentée dans les délais prévus, de manière correcte et conforme aux dispositions prévues par l'article 7 des présentes, ayant suffisamment démontré, de l'avis du Fournisseur, que les Produits sont défectueux, ce dernier décidera soit de livrer à titre gracieux des Produits remplaçant les Produits révélés défectueux, moyennant le renvoi de ces Produits défectueux, soit de réparer les Produits en question, soit d'accorder à l'Acheteur une remise sur le prix d'achat à définir en concertation mutuelle, sauf accord différent et formel convenu par écrit par le Fournisseur et l'Acheteur.
7. En exécutant l'une des prestations visées ci-dessus, le Fournisseur respectera intégralement ses obligations en matière de garantie et ne sera plus tenu à aucun autre dédommagement ou indemnisation.
8. Si le Fournisseur livre à l'Acheteur des produits qu'il a lui-même reçus d'autres fournisseurs, le Fournisseur ne sera jamais tenu d'accorder une garantie ou d'accepter de responsabilité envers l'Acheteur allant plus loin que ce que le Fournisseur peut réclamer de ses propres fournisseurs. En cas de vente de Produits vendus sous garantie d'un fabricant ou d'un importateur, la garantie ne couvre que les éventuels composants et/ou pièces individuels défectueux des Produits livrés par le Fournisseur à l'Acheteur.
9. Si les Produits livrés sous garantie d'un fabricant ou d'un importateur sont renvoyés pour être examinés dans le cadre de la garantie par le fabricant ou l'importateur en question, les frais éventuels à payer par le Fournisseur seront facturés à l'Acheteur. Le transport ou l'expédition des Produits en question pour leur examen, leur remplacement ou leur réparation par le fabricant ou l'importateur, est à la charge de l'Acheteur.
10. Le Fournisseur ne se porte aucunement garant pour des recommandations ou conseils relatifs à l'installation ou à l'utilisation des Produits, ni pour de tels conseils ou instructions de l'Acheteur à ses propres acheteurs. Le refus d'une autorisation de circulation ou de tout autre permis ou autorisation par une instance responsable, pour un Produit vendu par le Fournisseur, est entièrement aux risques et périls de l'Acheteur et ne lui donne aucun droit de résilier le Contrat ou de réclamer un dédommagement.
11. Les Produits restent entièrement aux risques et périls de l'Acheteur en cas de réparations par le Fournisseur sur les Produits, sauf si ces réparations sont consécutives à un défaut de prestation du Fournisseur et que l'on ne saurait raisonnablement attendre de l'Acheteur qu'il assure les Produits contre les risques ci-dessus.
12. Si l'Acheteur effectue ou fait effectuer par des tiers des réparations ou des modifications éventuelles sans l'accord préalable du Fournisseur, ce dernier n'est plus tenu de respecter ses obligations en matière de garantie. Ceci s'applique également en cas d'utilisation impropre des Produits par l'Acheteur ou par des parties liées, en tout cas, entre autres, en cas d'utilisation pour laquelle le Produit n'est pas raisonnablement prévu, selon le manuel d'utilisation.
13. En cas de remplacement par le Fournisseur de pièces/Produits dans le cadre de la garantie, les pièces et Produits remplacés deviennent la propriété du Fournisseur.
14. En cas de manquement de la part de l'Acheteur au respect correct ou dans les délais prévus de toute obligation découlant pour lui du Contrat conclu avec le Fournisseur ou d'un contrat y étant lié, le Fournisseur n'est tenu à aucune garantie – quel qu'en soit le nom – concernant aucun de ces contrats.
