Nous garantissons la qualité de notre matériel contre tout vice caché de fabrication pour la durée d’utilisation recommandée par le constructeur du matériel et, dans toute circonstance, au maximum de 12 mois à dater de sa livraison, en cas de respect des conditions ci-après. La garantie disparaît immédiatement et complètement si l’utilisation n’est pas conforme aux spécifications techniques, ou si le client modifie, répare ou fait réparer sans notre consentement le matériel fourni ou réparé. Avant la pose, une vérification visuelle est obligatoire pour vérifier la similitude avec le filtre changé. Tout vice apparent est couvert de plein droit par la réception sans réserve de la marchandise du vendeur. Après la pose d’un nouveau filtre, l’étanchéité et le bon fonctionnement du moteur doivent être contrôlés. Le vendeur ne sera pas responsable de la destination et/ou des conditions d’utilisations spécifiques de la marchandise dès lors que de telles sujétions ne lui auront pas été soulignées par écrit dans la commande. Nos garanties, quelles que soient leurs natures sont strictement limitées, avant montage au seul remplacement des filtres reconnus défectueux, et après montage, à la réparation des dommages matériels ou corporels directement survenus du fait d’un vice caché du produit livré, à l’exclusion de toute réclamation de nature immatérielle, indirecte ou subséquente. L’acquéreur a la charge de prouver le vice caché. L’avis de sinistre doit parvenir à notre Société immédiatement après la survenance du sinistre. Le filtre incriminé devant être expédié à nos locaux dans les 15 jours accompagné d’un échantillonnage d’huile.

Les normes utilisées ainsi la notice sont adaptées pour un usage professionnel ou grand public averti, avec pour seule restriction que le public en question soit :
- Expert / personne compétente / personne qualifiée : personne qui peut juger le travail assigné et reconnaître les dangers possibles sur la base de sa formation professionnelle, ses connaissances, son expérience et sa connaissance du matériel concerné
- personne avertie : personne informée des tâches assignées et des dangers possibles dus à des négligences
L’obligation de lire la notice d’instruction avant utilisation et le contenu de la notice d’instruction permettent d’informer l’utilisateur sur les taches réalisables et les dangers possibles dus à des négligences.
